I am in agreement with the staff that with appropriate restrictive covenants running with the land and other controls, there will be an adequate rationale for Utah's exemption from the land ownership requirements in 10 CFR Part 61.
I therefore have no objection to the course of action in this matter proposed by the staff.
However, the draft letter to the State of Utah in should be modified to reflect that the Commission has decided on this matter, and to enclose a copy of the SECY paper and SRM.
I furthermore agree with the staff's generic conclusion that, depending on the specific circumstances involved, land use and other controls can be an acceptable substitute for government land ownership.
The staff should provide a recommendation to the Commission as to the advisability of proceeding with rulemaking to reflect such a conclusion in an appropriate generic manner in 10 CFR Part 61.
