I approve the letter to the State of Utah as modified by the Chairman.
I also agree in principle with the Chairman's request for a staff recommendation on whether to proceed with a rulemaking on the generic conclusion on the acceptability of substitutes for government land ownership.
I believe, however, that the staff should first publish an Advance Notice of Proposed Rulemaking (ANPR) concerning the issue of applying the Utah decision on a generic basis. In the ANPR, staff should iterate the basis for the original requirement for government land ownership and ask for public comments on whether it should continue to be required in light of the Utah decision but noting that such ownership is not required for hazardous material disposal sites and sanitary land fills.
A review and analysis of public comments would provide a more substantial basis for a recommendation on whether i
