PROPOSED IMPOSITION OF CIVIL PENALTY - $12,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $12,500 will be issued on or about July 2, 1993 to Siemens Power Corporation.

This action is based on several violations identified as a result of a spill of about 124 kilograms of low enriched uranium powder on February 7,

1993.

The violations involved the installation and' unauthorized bypass of an interlock switch, the failure to perform a required criticality safety analysis (CSA) and the failure to identify and maintain adequate moderator exclusion controls.

The I

violations were aggregated as a Severity Level III problem because of the potentially significant lack of attention towards licensed responsibilities.

The escalation and mitigation factors were considered and, on whole, the base civil penalty amount of $12,500 was not changed.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice July 2, 1993 Telephone Notification of Licensee July 2, 1993 The State of Washington will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
