I approve the staff's proposals to initiate rulemaking to modify the design basis threat to include a land vehicle for transport of personnel and explosives, with provisions for additional security measures or alternative protection strategies when considering standoff distances, with the following comments:
1.
I agree with Commissioner Curtiss that the standard to apply should be that of the backfit rule (50.109) rather than the
" disproportionate cost" language proposed.
2.
To allow for meaningful public comment, the screening criteria (for safe standoff distances for various types of structures), should be available during the public comment period.
3.
While the staff should proceed as expeditiously as possible, a minimum comment period of 30 days should be provided.
