NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 70-1151/93-03)
This refers to the inspection conducted by C. Bassett of this office on-April 19-23 and.May 3-7, 1993. The inspection included a. review of activities authorized for your Columbia facility. At the conclusion of the inspection,z the findings'were discussed with those. members of your staff identified in' the-enclosed report.
Areas examined during the inspection are identified in the report? Within.-
these areas, the inspection consisted of selective; examinations of procedures and representative records, interviews with personnel, and observation of.
activities in progress.

Based on the results of this inspection, certain of your activities appeared:
to be in violation of NRC' requirements,. as specified in the. enclosed Notice of:
Violation (Notice). These. violations are of concern ~to the.NRC because:
- 1) implemented nuclear criticality safety controls for transfers to a non'-
favorable geometry blender were not adequate during-two incidents.where moisture analyses were not performed, 2) approved procedures were not'followed in several instances, and 3) moisture analyzers. required by your license application were removed without NRC approval. Of particular concern islthat certain of-the barriers thought by your staff to be in ~effect for the transfer
-to non-favorable. geometry blenders.and.to demonstrate compliance with'the Double Contingency Principle were inadequate-because the suppo'rting controls had not been fully or formally implemented. These-barriers involved the-ADU 1
calcining process and an oxidation. process, and that operators would-recognize that material contained excess moisture...
-In addition, the enclosed Inspection Report identifies activities thatL.
l violated NRC requirements'that will not be ' subject to enforcement ~ action'..
because the. licensee's efforts in identifying and/or correcting the' violation meet the criteria specified in-Section VII.B. of the Enforcement Policy.
You are required to-respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.

actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
The responses directed by this letter and the enclosed Notice are not subject 1
to the clearance procedures of the Office of Management and Budget as required i
by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
