Dear Mr. Chernoff:

4 We have reviewed Project Interface Documents (PID) No. 08-S-10 and No. 08-S-Il for the Gunnison, Colorado, Uranium Mill Tailings Remedial Action site. These were transmitted to us by letters dated May 27 and June 1, 1993.

PID 08-S-10, which is designated as Class I, proposes changes to site grading, ditch details, preload fill placement, and rock quality testing requirements.

The Nuclear Regulatory Commission staff concurs with PID 08-S-10,' but suggests that the proposed revision of drawing DS-10-0311 delete the word " final" from the indication of the contaminated materials surface, since the preload contaminated material will eventually be spread over this surface.

addition, acceptance of the rock quality testing change is principally because the rock quality appears to be excellent at this site, and should not be considered as generic approval for similar changes at other sites.

PID 08-S-11 is designated as Class II and III.

However, NRC staff believes that the Class II change, on the excavation of wetlands, warrants a Class I designation. The change relates to resolution of Issue 5 from the Final Remedial Action Plan (RAP), and involves the designation of areas as wetlands.

The revisions to drawings PS-10-0212 and -0213 delete the indications that wetlands will not be excavated. This change, coupled with the Gunnison Environmental Assessment's indication-that supplemental standards will be applied to two acres of Corp of Engineers-regulated wetlands in the windblown contaminated area (between Gold Basin road and the dirt runway), necessitates documentation that these areas to be excavated are not officially-designated wetlands. The Department of Energy (DOE) has not provided this information in either the RAP or the PID; however, DOE should provide information in the Completion Report that clarifies the status of these areas to be excavated as a result of this PID. Therefore, given that this clarification will be reviewed at the Completion Report stage, the NRC staff concurs on this portion of PID 08-S-Il and considers Final RAP Issue 5 closed.
