Dear Administrative Judges:
Reference is made to our letter to the Licensing Board of June 18, 1993.
After reviewing the more recently received Georgia Power Company's " Response To Intervenor's Information and brief Concerning Motion For Protective Order," which we received on June 21, 1993, as well as "Intervenor's Information and Brief concerning Motion For Protective Order" of June 9, 1993, the Staff has determined not to submit a response in this matter.
- However, the Staff wishes to call the Licensing Board's
-j attention to the Advisory Committee on the Rules of Civil 1
Practice's " Explanatory Statement Concerning Amendments of the Discovery Rules," on Rule 26 (b) (3 ) governing trail preparation materials, reprinted at 48 F.R.D.
487, 499-502 (1970), which the Staff believes is pertinent to this matter.
See also Westinghouse Electronic Corp. v. Republic of the Philippines, 951 F.2nd 1414, 1427-30 (3d Cir. 1991).
Further, the Staff emphasizes that other parties to this proceeding have no authority to claim privilege on the Staff's behalf.
