Dear Mr. Secretary:
Volume 58, No. 55 of the Federal Register includes a notice of proposed rulemaking by the NRC.
The proposed rule would reduce the random drug and alcohol testing rate from 100 percent to 50 percent for licensee employees, but maintains the 100 percent random testing rate for contractor and vendor employees.
This letter provides our comments on this proposed rule change.
We believe that contractor / vendor employees should be subject to the same 50 percent random testing rate as licensee employees. In our opinion, one of the primary reasons our program has not been challenged by contractor / vendor employees has been our determination to maintain absolute consistency in program implementation for all employees.
The continuation of this consistency will also eliminate any administrative problems associated with the use of two different testing rates.
