Company, licensee for-the Point Beach Nuclear Plant, Units 1 and~2, requested an exemption from the requirements of'10 CFR.50.60,
" Acceptance Criteria'for Fracture Prevention Measures for Light Water Nuclear Power Reactors for Normal Operation.",The requested exemption would have authorized the~ application of ASME-Section XI' Code Case N-514, " Low Temperature Overpressure Protection," for.
determining the acceptable-low temperature-overpressure mitigating l
system setpoint for PBNP.

During recovery and startup following the recently_ completed PBNP Unit 1 maintenance and refueling outage, administrative restrictions were placed'on reactor coolant pump operation to ensure the existing low temperature overpressure mitigating' setpoint provided the design'1evel of protection.
Operation of Unit 1 with the administrative controls.'in place did.not place an unduo burden on the operators or. adversely-affect safe and reliable operation.
We have determined, therefore, that the requested exemption is not necessary and are withdrawing our request.'
