e NOTICE OF VIOLATION Centerior Service Company Docket No'. 50-440 Perry Nuclear Power Plant License No. NPF-58 During an NRC inspection conducted on May 10 through 21, 1993, violations of:
NRC requirements were identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violations are listed below.

Title 10 of the Code of Federal Regulations, Part 50, Appendix B,
(
Criterion V, Instructions, Procedures, and Drawings, requires, in part, H
that activities affecting quality shall be prescribed by procedures of a type appropriate to the circumstances.
Contrary to the above, procedure PAP-0524, Attachment I was not appropriate to the circumstances during the inspection conducted through May 21, 1993, in that the procedure permitted use of a flowchart symbol with the phrase " Emergency Depressurizatinn is Required" in a manner not consistent with other emergency operating procedure applications which used the same flowchart symbol.
This is a Severity Level IV violation (Supplement 1).

-Title 10 of the Code to Federal Regulations, Part 50, Appendix B, Criterion XVI, Corrective Action, requires, in part, that measures shall be established to assure that conditions adverse to quality are promptly identified and corrected.
Contrary to the above, a condition adverse to quality identified during

the 1991 E0P Inspection concerning ineffectiv'e validation and verification (V&V).was not corrected by the end of the inspection conducted through May 21, 1993, in that subsequent V&V reviews of E0Ps had not identified that the " UNSAFE" region of the E0P Heat Capacity Limit figure was not labeled as required by PAP-0524, Attachment 1.
This is a Severity Level IV violation (Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, Cen % rior Energy is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATIN: Document Control Desk, Washington, D.C. 20555 with a copy to the U.S. Nuclear Regulatory Commission, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois, 60137, and-a copy to the NRC Resident Inspector at the Perry Nuclear Power Plant within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:
(1) the reason for the violation, or, if contested, the basis for' disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other act' ion as may be proper should not be taken. Where good cause is-shown, consideration will be given to extending the response time.
