The Commission (with Commissioners Rogers, Remick and de Planque agreeing) approved a Memorandum and Order detailing the Commission's review of a settlement agreement between the NRC l
staff and Dr. Randall C.
Orem.
The order indicates that the Commission will not overturn the settlement agreement; however, the Commission does provide guidance on certain matters of regulatory policy.
The Chairman and Commissioner Curtiss disagreed in part they would have disapproved the stipulation in l
the settlement agreement by which none of the facts associated with the proceeding would be held against Dr. Orem in future licensing actions.
The Chairman's and Commissioner Curtiss' l
dissenting views were attached to the order.
(Subsequently, on June 4, 1993, the Secretary signed the Order. )
II.
SECY-93-155 - Oncoloav Services Corporation's Petition for Review of LBP-93-6 The Commission, by a 5-0 vote, approved an order responding to'a petition filed by Oncology Services Corporation seeking interlocutory review of the Atomic Safety and Licensing Board's Memorandum and Order (LBP-93-6) which granted the Nuclear Regulatory Commission staff's motion for stay of this enforcement proceeding through June 23, 1993.
The order grants interlocutory review, but postpones any further consideration of the matter until af ter the Licensing Board resolves any further request for a stay.
