The Commission was briefed by the NRC staff, DOE and the U.S.
Enrichment Corporation on the efforts to transition the gaseous diffusion plants to a government enterprise with NRC oversight.
Noting DOE's position that the NRC should not assume regulatory responsibility until the Commission has promulgated the standards required by the Energy Policy Act of 1992 as well as DOE's statement at the briefing that it will continue to regulate the gaseous diffusion plants until NRC assumes responsibility, the Commission-has determined that NRC will assume regulatory responsibility after NRC establishes the-standards and completes the first certification process for the plants, as required by the Energy Policy Act of 1992.
Until such time as NRC assumes responsibility, DOE will continue to regulate the plants.
OGC should respond to the DOE Deputy General Counsel's recent letter that NRC agrees DOE can continue to regulate until NRC assumes responsibility after issuance of standards and completion of the first certification process.

The Commission requested that when the staff submits a proposed rule dealing with regulation of the gaseous diffusion plants, it also provide an estimate of the plant's level of compliance with the proposed rule.
