SECY-93-067 - FINAL PpIiICY STATEMENT ON TECHNICAL SPECIFICATIOFS IMPROVEMENTS The Commission (with all Commissioners agreeing) has approved publication of the policy statement in final form subject to the following comments:
o The Commission is of the view that the four criteria should be codified in a rule.
Accordingly, the staff should prepare a rulemaking package and submit it to the Commission for review and approval.
The Federal Reaister notice (FRN) announcing the policy statement should include a statement that the Commission is initiating a notice and comment rulemaking action to codify the four criteria, in a manner consistent with the policy statement.
In developing tb2 proposed rule, the staff should ensure that the volur.tccy nature of the improved standard technical specificatic,.:
(STS) progran is preserved.
The FRN should note that connents on the policy statement are welcomed and that they will be considered and addressed during preparation of the proposed rule.
The staff should also initiate preparation of any regulatory guides, as appropriate, which may be needed to implement this rule.
o Prior to publication, the staff should modify the policy statement to clarify how it intends to utilize the PSA as part of its review of technical specification change requests.
The staff should explain that if the results of the PSA indicate that technical specifications can be relaxed or removed, a deterministic review should be performed, and if the results of the deterministic review also support relaxing or removing the technical SECY NOTE:

12/17/93) l The Commission supported the staff proposal to allow licensees to adopt portions of the improved standard technical specifications without implementing all of the STS improvements.
The portions adopted will need to include all requirements related to the ite=s being changed, as described in the paper.

The staff should aggressively explore and pursue possible mechanisms for improving NRC's regulations related to technical l
specifications including achieving legal and administrative efficiencies in the processing of amendments to technical specifications.
See the recent SRM dated April 16, 1993 on the Regulatory Review briefing.
While the Commission does not wish to delay the publication of the policy statement and the rule i
codifying the four criteria pending completion of the staff's analysis of this issue, the staff should give this effort high priority.
The staff should inform the Commission of its plans in this regard when the rulemaking package is forwarded for Commission review.
