Dear Mr. Brown:
This will confirm your telephone conversation with Nancy Osgood of my staff on June 10, 1993, in which we stated that the fire-retardant foam in the packaging described in Certificate of Compliance No. 9019 may not contain the typical 3.2% baron as stated for the chemical composition for the foam.
Presence of boron was u ed in the criticality safety analysis for an array of damaged packages.
This will also confirm that NRC licensees have agreed not to use the Model No.
BU-7 packaging, without prior approval of the NRC. Request for approval is to include the type and form of material, the maximum quantity of material per package, the amount of boron present in the packagings and a criticality safety analysis for a damaged array.
Since the Department of Energy is a registered user for this package, we have also informed them of the action we j
have taken.
