I am responding to your letter of April 2,1993, to the Chairman of the U.S. Nuclear Regulatory Commission (NRC) on your concerns about the Commission's current reassessment of the priorities and manpower allocations for the preapplication reviews of the advanced reactor and CANDU 3 designs.
These are similar to the concerns expressed to us by AECL Technologies (AECLT), the preapplicant for the CANDU 3 design.
This reassessment is necessary because of the budget and manpower reductions being imposed on the Commission by the new administration and is being made on all aspects of NRC work, including the preapplication reviews.
Because we have not completed this reassessment, we cannot tell you how the CANDU 3 review schedule may be changed.
The NRC is currently reviewing four light-water reactor standard designs for standard design certification (SDC) under 10 CFR Part 52.
The applicant for each of these designs has submitted a formal application for an SDC in accordance with the regulation. AECLT has not submitted an application for standard design certification under Part 52.
The NRC is conducting a preap-plication review effort pursuant to the Commission's Advanced Reactor Policy Statement of 1986.
We understand that a significant change in our presently scheduled date of December 1994 for completion of the preapplication review of the CANDU 3 design may impair the AECLT schedule to certify the CANDU 3 design in the United States. We will consider the several points raised in your letter during our reassessment and, in accordance with the Canada-U.S. Free Trade Agreement, we will accord the CANDU 3 design the same consideration as the other preapplicatica designs we are reviewing.

Dear Dr. Selin,
I am writing to indicate the interest of the Canadian government for the continuation by the Nuclear Regulatory Commission of its on-going program on the design certification of the CANDU 3.
Work is now well advanced in the pre-application phase after which it is AECL Technologies' (AECLT) plan to apply for formal design certification which results in a U.S.
NRC license.
As you know, AECLT pays for the licensing effort expended by tne NRC under the NRC's 100% cost recovery requirements.
The CANDU is a successful, economic, reliable and proven product that is of interest to U.S.
utilities.
To offer the CANDU 3 in the U.S.
market, a license is required from the NRC.
Any decision by the NRC to curtail AECLT's certification program would adversely affect the company's ability to competitively offer the CANDU product in the U.S.
If, as a result of resource reallocation by the NRC, work is stopped on the CANDU review, AECLT would be locked out of the U.S. market, which would be inconsistent with the provisions of the Canada-U.S. Free Trade !,

Furthermore, the decision would inhibit AECL sales program in other markets.

or delay the pre-application activities that have been planned for j
the CANDU 3 design.
