Licensee: Steel Warehouse Company, Inc. (EA 93-115)
South Bend, Indiana (General Licensee) j Subiect:
PROPOSED IMPOSITION OF CIVIL PENALTY - $250-This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of S250 will be issued on or about June 8, 1993, to Steel Warehouse Company, Inc.,
of South Bend, Indiana.
Steel Warehouse is generally licensed to use byproduct material contained in thickness measurement devices.
The company has 3 fixed gauging devices containing Am-241.
When one of them was damaged, the company shipped it back to the vendor in a cardboard box in violation of several DOT transportation requirements. for labelling and packaging.
Collectively,- these violations constituted a Severity Level III violation of 10 CFR 71.5(a).
The base civil penalty is $500 and this was mitigated 50%
for corrective actions.
None of the other factors were applied.
It should be noted that the licensee has not been specifically informed of the enforcement action.

The licensee has 30 days from the date.of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
