Dear Mr. DeLaBarre:

We are forwarding a letter dated June 3,1993 from Nissho Iwai American Corporation with a request to change the end user for high enriched uranium (HEU) originally exported to Japan under the authority of export license XSNM02468 for use in the JRR-2 Research Reactor at the Japan Atomic Energy Research Inst'tute (JAERI), JAERI now requests that the HEU be authorized for use in the JMTR Research Reactor at JAERI. After the HEU had been exported to France for fabrication, JAERI reviewed the reactor operation schedule and concluded that it was more desirable to use the JRR-2 material for JMTR fuel fabrication.

The quantity of HEU (45.90% enriched) involved consists of 22.343 kilograms of uranium containing 10.054 kilograms of uranium-235.

This request is similar to previous requests involving the KUHFR, JMTR, JRR-2 and JRR-4.

A new end use statement has been provided as well as the Reactor Checklist for export license XSNM02467 which authorized the export of 85.56 kilograms of uranium containing 38.50 kilograms of uranium-235 (45.1990% enriched) for use in the JMTR. Only 66.40 kilograms of uranium was actually exported under that authorization, 19.16 kilograms less than the amount authorized.

Before taking action on this request we would appreciate your views as to whether the proposed new end use for this material meets the applicable criteria in the Atomic Energy Act, as amended.
