For FY 1992 Combustion Engineering paid annual fees, including late charges,
' totalling $1,691,064.54 for the Windsor, Connecticut and Hematite, Missour1 facilities (License Nos. SNM-1067 and SNM-33, respectively). : Based on the per curiam Order of April 30, 1993, by the U.S. Court of _ Appeals for the District of Columbia Circuit,.which directed the Commission to grant an exemption from
'the FY 1992 annual fees for one of the facilities, the Commission grants an~
exemption from the annual fee for FY 1992 in the amount of $845,532.27 for the Windsor facility,. License No. SNM-1067.
Based on the above, Invoice Nos. AM00001-92, AM00042-92,'AM00087'-92, and AM07309-92. have been cancelled and the NRC is requesting the Department of the; Treasury to refund $845,532.27 to your company. Normally, refunds are processed within 30 days.
The proposed revisions to 10 CFR Parts 170 and 171 for FY 1993, which were -
published in the Federal Register on April 23,1993. (58 FR 21662), state that the Commission proposes to exempt the Windsor facility from the FY 1993 annual fees. Upon publication of the final rule in the Federal Register, appropriate action will be taken on the FY 1993 payments made by Combustion Fogineering-for the two facilities.
