REQUEST FOR APPROVAL FOR EXTENSION OF TIME
FOR CHEMICAL AND GEOLOGICAL LABORATORY
Attached for your review is correspondence from Chemical and Geological
Laboratory dated August 13, 1991, and a Statement of Facts regarding License
No. 50-17150-01. The licensee was billed an annual fee under invoice No.
AM08605-91.
Based on the information furnished, the Office of the Controller recommends
that you approve the request for an extension of time to terminate for
purposes of avoiding the FY 1991 annual fee to August 13, 1991.
Licensed
activities ceased prior to September 30, 1991, and the license was terminated

STATEMENT OF FACTS

The licensee sent two letters dated August 13, 1991. One requested
termination of License 50-17150-01 and the other requested a waiver of the FY
1991 annual fee (Invoice AM08605-91). Although the license was terminated in
accordance with their request, the request for a waiver of the annual fee was
not responded to at that time.
The final rule revising 10 CFR 170 and 10 CFR 171 provided an opportunity for
licensees who wished to relinquish their licenses and who were capable of
permanently ceasing licensed operations by September 30, 1991, to avoid the FY
1991 annual fee if the licensee notified the Commission in writing within the
30-day period prior to the effective date of the rule (56 FR 31475 and 31485;
July 10, 1991).
As stated in the Federal Register notice, and the notice
which was mailed with the invoice, the effective date of the rule was
August 9, 1991.
Since the request for termination was dated August 13, 1991,
it was not considered timely-filed for purposes of avoiding the FY 1991 annual
fee.
The bases for the request are: (1) the license was for sealed detector cells
used in gas chromatograph. instruments; (2) the cells possessed are authorized
under system licenses held by Varian Corporation and Hewlett-Packard
Corporation; and (3) an individual license is not needed for these devices
and, as such, the activities are not subject to NRC licensing and should not
be subject to the annual fee.
Based on the information provided, the Commission: (1) grants a five-day
extension to the time to file for termination for purposes of avoiding the FY
1991 annual fee; (2) acknowledges that any activities conducted in FY 1991
involved generally-licensed devices for which a specific NRC license was not
required; and (3) acknowledges the license was terminated December 17, 1991.
Invoice AM08605-91 should be cancelled.
