May 28, 1993 EN 93-054 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee:

Houston Lighting & Power Company (EA 93-057)

(South Texas Project Units 1 & 2)

Docket Nos. 50-498 and 499 Subiect:

PROPOSED IMPOSITION OF CIVIL PENALTIES - $ 325,000 This is to inform the commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the cumulative amount of $325,000 will be issued today, May 28, 1993, to the Houston Lighting & Power Company.

This action is based on two Severity Level III problems, each involving multiple violations.

This action was submitted to the Commission in SECY-93-146 and today the Commission indicated that it had no objection to the issuance of the action.

In the first, the most significant violation involved the inoperability of the Unit 1 turbine-driven auxiliary feedwater pump for approximately 33 day.

In the second, the most significant violation involved the inoperablity of one of the Unit 1 emergency diesel generators for a period of approximately 24 days.

A civil penalty of $175,000 is being proposed for the first problem after finding escalation was appropriate for NRC identification, multiple opportunties to identify, and duration.

A civil penalty of $150,000 is being proposed for the second problem after finding escalation appropriate for prior opportunties to identify and duration.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice May 28, 1993 Telephone Notification of Licensee May 28, 1993 The State of Texas will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
