OMB SUPPORTING STATEMENT FOR NRC FORM 450, GENERAL ASSIGNMENT EXTENSION PACKAGE (3150-0114)
-Description of the Information Collection l
As a part of the contract closeout process for cost-reimbursement and time-
}
and-materials-type contracts, the contractor is required to assign to the Government all rights, title and interest to refunds, rebates, credits or other amounts (including interest, if any) arising out of contract performance i
and certify that a corporate official is empowered to make the assignment.
The contractor utilizes NRC Form 450 to make such assignments.
j This extension package is classified as a revision as it increases the number of respondents from 120 to 400. There is no change in the information collections.
A.
JUSTIFICATION 1.
Need for the Collection of Information.
Contract clauses 52.216-7, Allowable Cost and Payment (JULY 1991) and 52.232-7, Payments under Time and Materials and Labor Hour Contracts (APR 1984) prescribed by the Federal Acquisition Regulation (FAR) for inclusion in cost-reimbursement and time-and-materials contracts require execution and delivery of the assignment, in form-and substance satisfactory to the Contracting Officer as a condition precedent to final payment.
l 2.
Aaency Use of Information.
General Assignment forms are reviewed upon receipt to assure proper execution and certification. They then become an integral part of the official contract file serving as the legal basis for subsequent actions required on the part of the Contractor for collection of all refunds, rebates, credits or i
other amounts properly allocable to costs for which the contractor has been reimbursed by the Government under the contract, and payment of collected proceeds to the Government.
3.
Reduction of Burden Throuch Information Technoloov. The burden represented by the execution and certification of the General Assignment is minimal thus the opportunity for reduction of burden.
through information technology does not present itself.
Notwithstanding, the need to maintain legal sufficiency of the-l assignment could pose a legal obstacle in consideration of use of l
information technology for reduction-of burden. However, if any such concerns can be satisfied, NRC has no objection to use of information technology to reduce the burden.
4.
Effort to Identify Duplication.
The Information Requirements
'I Control Automated System (IRCAS) was searched to determine duplication and none was found.
5.
Effort to Use similar Information. The information is contract i
specific, thus similar information does not exist which could j
satisfy the specific contractual requirement.
NRC in its contract j
i I
2 closeout process, forwards the General Assignment for execution as soon as practicable after reconciliation of the final cost information. At the same time, the contractor's " release" is forwarded for execution, as an effort to reduce the overall burden to the contractor.
6.
Effort to Reduce Small Business Burden. The information collection is prescribed by the Federal Acquisition Regulation.
The collection represents the minimum required for proper execution of the General Assignment and cannot be reduced.
7.
Consecuer.ces of less Frecuent Collection.
Not applicable. The information collection is required only once, at the time of l
contract closeout.
8.
Circumstances Which Justify Variation From OMB Guidelines.
The collection is within all OMB prescribed guidelines.
9.
Consultations Outside the NRC.
None.
10.
Confidentiality of Information.
Execution and certification of the General Assignment does not require use of confidential information. Any subsequent submission of proprietary or business confidential information would be protected against improper disclosure as required by the Federal Acquisition Regulation, the Freedom of Information Act and NRC Hanagement Directive,' Volume 12, " Security."
11.
Justification for Sensitive Ouestions. No sensitive information i
normally considered private or personal information is required or requested.
12.
Estimated Annualized Cost to the Federal Government. The cost to the Government was derived from experience as to the approximate number of hours Contract Specialists expend in assuring that the form is properly executed and that the contractors comply with the form and review of the information therein. Annual cost to the Government is estimated at $24,600 (.5 hr. per form x 400 forms x
$123/hr. ).
4 13.
Estimate of Burden. The annual contractor burden for this form is estimated to be 800 hours0.00926 days
0.222 hours
0.00132 weeks
3.044e-4 months
. The burden estimate was derived from experience as the approximate number of contractors affected by-the General Assignment form and the approximate number of hours each Contractor would have to expend to comply with the requirements of the form (400 respondents x 2 hrs. per response).
The estimate of 2 brs. per response is based on the following steps being taken to complete the General Assignments Form:
Search and review of contract records and verification by an accounting department (may involve data which must be i
9 4
T 3
retrieved from storage)
This form must be notarized Clerical support required to complete the form i
The burden estimate also takes into account whether a contractor maintains a manual or automated accounting system.
14.
Reasons for Chance in Burden.
Because the NRC did not have j
sufficient staff to manage the closecut process, a large backlog accumulated. The increase in the number of respondents in this clearance period is a result of acquiring a contractor to provide the necessary personnel, supervision, and, at the option of the NRC, to furnish and maintain an automated contract closecut and i
deobligation tracking system to assist the Division of Contracts and Property Management, Contract Administration branches in the performance of the contract closecut responsibility. The i
estimated number of contracts to be closed out annually is 400.
j 15.
Publication for Statistical Use.
Results will not be tabulated or published.
i B.
COLLECTIONS OF INFORMATION EMPLOYING STATISTICAL METHODS This collection of information does not employ statistical methods.
