NRC INSPECTION REPORT NOS:
70-1151/92-04 AND 70-1151/93-01 In connection with the violations assessed a civil penalty in the referenced report, Westinghouse Electric Corporation hereby remits the entire $18,750 of the proposed civil penalty, including the base penalty of $12,500 and the escalated portjon in the amount of
$6,250.
We believe, however, that escalation of the. civil penalty' above the base amount is inappropriate and reflects the current heightened expectations of the NRC regarding criticality control' rather than lack of responsiveness or safety awareness on.our part.
Containers of the type. cited in the violation have been used safely at the plant since operations began in 1969.
Accordingly, we do not view our actions as warranting anything but the lowest level penalty.
However, we do not wish to prolong a deliberation over an issue which has been appropriately addressed, and hereby remit'the entire amount of the proposed penalty.
