NRC INSPECTION REPORT NO. 999-90001/93-01 Thank you for your response of April 26, 1993, to our Notice of Violation issued on March 29, 1993, concerning activities conducted at your Ponce, Puerto Rico facility.

We have evaluated your response and found that it meets the requirements of 10 CFR 2.201.

We will examine the implementation of your corrective actions during future inspections.

REPLY TO A NOTICE OF VIOLATION This refers to the notice of violation of NRC requirements issue by your office on March 29, 1993. On August 1, 1989 I started my ophthalmology practice at the office of Dr. Luis A. Morales, an ophthalmologist who held a NRC license to posses and use a Strontium-90 eye applicator.

Dr. Morales wanted to retire so I started the practice with him using on occasions his eye applicator. On January 1990 we finish the deal on the office and with it I continue to use the eye applicator until January 1993 when I received an inspection by your office; at that time they found that I was not listed as an authorized user of the source. ' et me tell you that I was completely unaware of the requirements of a

w license I thought that the license itself is for the source and not for the user. At my residency training I was trained using this eye applicator an I didn't have a license for myself. Further more I had been paying NRC annual fee for the past two years in order to kept the licence in good standing. Any how the unknow of the requirements on my part didn't relieve me of the responsability of the law so I take the following step in order to correct the violation

1. I apply for a by product material license within 14 days of the confirmation of action letter, received on January 1993 specifiying the action to be taken by me on this matter. I received my license on April 1993.

2. I'm in the process of leak test the source prior to starting his use, and it is still place in a locked storage at my office; the result of the test will be available in the next weeks actually in 1

process by the Medical College of Virginia, Off5ce of Enrironmental Health & Safety.

3. I will notified NRC Region ll, Attn: Chief Nuclear Material Inspection section when the activities autt rized by the license will be initiated.

No further violations will be issue on this matter since I received the NRC license and I will be aware of the compliance of risks and regulations on the use of the source; some of then appointent in the inspection.
