For FY 1991, Combustion Engineering paid annual fees totalling $1,680,000 for the Windsor, Connecticut and Hematite, Missouri facilities (License Nos.
SNM-1067 and SNM-33, respectively).
Based on the March 16, 1993, decision of the U.S. Court of Appeals for the District of Columbia Circuit, which directed the Commission to grant an exemption from the FY 1991 annual fees for one of the facilities, the Commission grants an exemption for FY 1991 in the amount of $840,000 for the Windsor facility, License No. SNM-1067.
Based on the above, Invoice No. AM01091-91 has been cancelled and the NRC is

requesting the Department of the Treasury to refund $840,000 to your company.
Normally, refunds are processed within 30 days.
The Commission also intends to refund a portion of Combustion Engineering's FY 1992 annual fee payments following the dispositon of your company's petition for review of the NRC's exemption denial in accordance with the NRC's
" Consent Motion for Consolidation And Summary Disposition of Cases Held in l
Abeyance," filed April 9, 1993.
