PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about May 21, 1993 to the Commonwealth Edison Company.
This action is based on the discovery by licensee personnel that contrary to the unit technical 3
specifications, during the previous operating cycle the unit operated without en operable reactor vessel head vent system.
Both trains of the system were inoperable due to a closed common manual isolation valve which was not properly aligned to the open position following the previous refueling.
This violation has been classified at Severity Level III.
A civil penalty equal to the base civil penalty is being proposed after offsetting mitigation for the licensee's corrective actions and the initiative shown in determining the root cause of this self-disclosing event with escalation for the duration of the inoperable system.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice May 21, 1993 Telephone Notification of Licensee May 21, 1993 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or_ imposed by order.
