Dear Mr. Soden:
In response to your letter dated September 4,1992, we have reconsidered the l
proposed license denial issued to you on August 19, 1992, and have reviewed the grading of the operating test administered to you on July 16,1992, along with the information you supplied contesting the grading.
We find that you j
did not pass the operating test. The result of our review is enclosed.
Consequently, the proposed denial of your license application is sustained.
l If you accept the proposed denial and decline to request a hearing within 20 days as discussed below, the proposed denial will become a final denial. You may then reapply for a license pursuant to 10 CFR 55.35.
If you accept this proposed denial, the following information is provided:
a.
Because you passed a written examination on July 14, 1992, and the walk-through portion of an operating test on July 18, 1992, you may request a waiver of these portions. This waiver will be granted by the NRC and will be valid up to one year from your examination date.
i b.
Because you did not pass section C of the operating test administered to you on July 16, 1992, you will be required to retake section C of the operating test.
c.
You may reapply for a license two months from the date of this letter. A reexamination will be scheduled, upon request by you or
.i your facility management, shortly after receipt of your reapplication.
If you do not accept the proposed denial, you may, within 20 days of the date of this letter, request a hearing pursuant to 10 CFR 2.103(b)(2). A hearing
-i request is required to be submitted, in writing, to the Secretary of the Commission, U. S. Nuclear Regulatory Commission, Washington, D. C.

with a copy to the Assistant General Counsel for Hearings, Office of the General Counsel, same address.
