This responds to your letter dated May 11, 1993, requesting an extension of the comment period from May 24, 1993 to July 19, 1993 for the proposed rule on 100 percent fee recovery published April 23, 1993, in the Federal Reaister (58 FR 21662-21692).
Your request to extend the comment period on the proposed Parts 170 and 171 of l
the Commission's regulations is denied because of the severe time constraints imposed on the NRC by Public Law 101-508.
The Public Law requires that the NRC publish effective fee rules to ensure collection of approximately 100 percent of the FY 1993 budget authority by September 30, 1993.
It is also the Commission's intent to resolve the U.S. Court of Appeals remand issues no later than the issuance of the FY 1993 final rule. Therefore, as indicated on page 21662 of the proposed rule, requests for extensions of the comment period would not be granted. The time period between May 24, 1993 and the end of August is the minimum required for the Commission to evaluate the public comments received for consideration; modify, as appropriate, and publish the final rule; bill the licensees by August 30 and thereby provide a minimum of 30 days for licensees to pay the fees before the close of the fiscal year.
