SUBJECT: NRC INSPECTION REPORT 50-458/93-02 (NOTICE OF VIOLATION)

This refers to NRC Inspection Report 50-458/93-02 regarding an inspection

conducted by Mr. A. B. Earnest of this office on January 19-22, 1993.

The

inspection report included an Unresolved Item (URI 485/9302-01) involving the

implementation of the contingency portion of the Physical Security Plan.

The

status of this Unresolved Item was discussed during a management meeting held

at our office on April 12, 1993.

Based on the discussions at the management

meeting, it was concluded that Security Contingency Procedure PSP-4-409 was

inadequate to implement the Physical Security Plan. The failure to implement

specified security actions is considered a violation of your Physical Security

Pl an.

Therefore, Unresolved Item URI 458/9302-01 is closed as an Unresolvea

Item but is reclassified as a violation.

Unresolved Item URI 458/9308-03 is closed as a result of information your

staff presented during the management conference on April 12, 1993. The

l

unresolved item related to the uninterruptible power supply for the plant

security systems.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions and any additional actions

l

.

you plan to prevent recurrence. After reviewing your response to this Notice,

,

l

including your proposed corrective actions and the results of future

inspections, NRC will determine whether further NRC enforcement action is

i

l

necessary to ensure compliance with regulatory requirements.

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget, as

I

required by the Paperwork Reduction Act of 1980, Pub. L. No. 96.511.
