Dear Mr. Thorne:

Enclosed is an application for an export license (XSNM02748), recently received by the Nuclear Regulatory Commission, for the export of high-enriched uranium in the form of mixed uranium and thorium carbide as unirradiated, fabricated fuel. The fabricated fuel is to be exported to COGEMA, France for processing and recovery of the uranium. The recovered uranium, in the form of metal, and the thorium, will be returned to Nuclear Fuel Services, Inc. in the United States.

Before taking action on this request, we would appreciate your views, from the overall perspective of the Executive Branch, as to whether the proposed export meets the applicable criteria in the Atomic Energy Act of 1954 as amended by the Nuclear Non-Proliferation Act of 1978.

Sincerely, WM b DM Ronald D. Hauber, Assistant Director Exports, Security, and Safety Cooperation Office of International Programs
