NOTICE OF VIOLATION NRC INSPECTION REPORT NO. 70-734/93-01 This letter refers to the routine inspection conducted by Mr. C. A. Hooker of this office on January 11-15, 1993, and in-office inspection of licensee 21-22, 1993, of activities authorized by NRC license No.

materials on January SNM--696 and to the discussion of our findings held by Mr. Hooker with you and other members of your staff at the conclusion of the inspection.

Areas examined during this inspection are described in the enclosed inspection Within these areas, the inspection consisted of selective report.

examinations of. procedures and representative records, interviews with personnel, and observations by the inspector.

Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice). In addition to the violations specified in the enclosed Notice, the inspection report also describes one violation that is not being cited because the criteria specified in Section VII.B (1) of the Enforcement Policy were satisfied.

I am concerned with the types of problems and apparent violations that have been identified at your facility. An adequate criticality safety program must include several elements such as the analysis of potential process upsets that may affect criticality safety, timely evaluation of upsets when they occur, and timely involvement of management in the evaluation. There has been considerable NRC emphasis on management of criticality safety programs and the need for licensees to review the adequacy of CSAs. The NRC expects licensee i

management to take the initiative to identify and correct deficiencies in their programs. NRC Information Notice No. 90-63,

  • Management Attention to the Establishment and Maintenance of a Nuclear Criticality Safety Program,"

was issued on October 3, 1990. That Information Notice was provided to alert-t licensees to an incident that resulted from inadequate management attention to the establishment and maintenance of a nuclear criticality safety program.

Attached to that Information Notice was NRC Information Notice No. 89-24,

" Nuclear Criticality Safety," issued March 6,1989. Both of these information notices highlighted the need for continuing vigilance in providing a sound nuclear safety program, and should have prompted your staff to review the i
