REQUEST FOR MODIFICATION OR WITHDRAWAL OF PROPOSED TECHNICAL SPECIFICATION CHANGE ~RELATED TO SAFETY VALVE AND SAFETY RELIEF VALVE.

SETPOINT TOLERANCE'(TAC NO. M75939)

By letter dated January 26, 1990, the Nebraska Public Power District (NPPD) submitted to the NRC staff a request that the Cooper Nuclear Station (CNS)-

Technical Specifications (TS) be revised to increase the setpoint tolerance -

for both the safety valves and safety relief valves from i I percent'to..

t 3 percent.

Your request also included the use'of. an upper limit pressure of..

1277 psig for the safety valves and an upper limit pressure'of 1210 psig for:

the safety. relief valves.

On July 9,1990, the Boiling Water Reactor Owners' Group (BWROG) submitted for NRC staff review the General Electric Company's~ (GE)? generic, proprietary, topical report, NEDC-31753P, "BWROG In-Service Pressure Relief Technical Specification Revision Licensing Topical Report.' The staff review of your. TS change request was deferred until the staff review'of the generic topical report was completed.

The NRC staff recently completed its review of-NEDC-31753P and issued a-generic safety evaluation (SE). The_ generic SE was transmitted to the BWROG-by a letter dated March 8, 1993, from Ashok C.- Thadani, USNRC,.to.Cynthia L..

Tully, Chairperson, BWROG. The staff's SE concluded that a-change of valve:

setpoint tolerance from i I percent to i 3 percent'is acceptable. : However,-

the SE also concluded that the philosophy of an upper' limit-is.not acceptable.

Therefore, this aspect of your proposed TS change is not acceptable..

The NRC letter of March 8,1993 requested that the BWROG publish' accepted versions of the topical report within 3 months. of receipt of the letter.

Because your TS change request will: require considerable rework to meet-the.

staff criteria specified in' the generic SE, we' request 'that you review in detail the staff's SE as well as the accepted version of NEDC-31753,'when-issued. Then, if you choose to pursue safety and safety relief valve:setpoint tolerance r.hanges, we request that you submit a' revised request superseding; your TS change request of January 26, 1990. To facilitate an expeditious n

review, the revised request should include TS changes that conform to the criteria specified in the.SE with the necessary supporting information, also [

as.specified in the SE.
