RESPONSE TO TECHNICAL ASSISTANCE REQUEST FROM REGION I RE: STATEMENT OF INTENT BY GOVERNMENT " CONTROL" ENTITIES This memorandum is in response to your memorandum dated February 13, 1990, requesting further guidance on how to determine whether or not a university or hospital may use a statement of intent to fulfill its financial assurance requirement as specified in 10 CFR 30.35, 40.36, and 70.25.
After consultation with the Office of General Counsel and the Industrial and Medical Operations Branch, the following guidance should be employed:
1.
If an institution is listed in the " Directory of Post Secondary Institutions" as a public institution or the "American Hospital Association Guide to the Health Care Field" as a public institution it is assumed to be controlled by a government agency and its listing is acceptable for all or part of the mechanism.
2.
The government agency has to provide the statement of intent, which must be signed by a person authorized to make the guarantee.
3.
If it is for part of the total of the required assurance, the portion which is not covered by the government statement of intent must be covered by another acceptable mechanism.
