PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 This is to inform the Comission that a Notice of Violation and Proposed Is; position of Civil Penalty in the apunt of $75,000 will be issued on or about July 16, 1990 to Philadel ahia Electric Contany. This action is based on three-violations identified wit 1 the design and operation of the emergency service water system. The-base civil penalty of $50,000 was escalated a total of 100%
based on NRC identification of the violations and prior notice of one of the violations.
The escalation was partially offset by 50% mitigation for the i
licensee's pron.pt and extent,ive corrective actions resulting in a prcposed civil penalty of $75,000.
It should be noted that the licensee has not been specifically infors,ed of the I-enforcement action. The schedule of issuance and notification is:
L Mailing of Notice July 16, 1990 Telephone Notification of Licensee-July 16, 1990 The Comonwealth of Pennsylvania and the State of Maryland will be notified.,
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of-the response, the civil penalty may be remitted, mitigated, or imposed by Order.
