.1 JOINT MOTION TO DEFER WRITTEN FILING DUE JULY 9, 1990 AND TO DEFER FURTHER ACTION BEFORE THIS BOARD IN THE ABOVE CAPTIONED PROCEEDINGS INTRODUCTION I

By Memorandum and Order (Deferral of Filings and Further Action), dated May 9,

1990, (unpublished), the Board granted a joint motion dated May 7,1990, by the NRC Staff and Mr. Dickherber (through counsel) to defer the filing date for responses to Mr.'Dickherber's answer and for the scheduling of a prehearing conference in the above captioned proceedings.

DISCUSSION On June 1, 1990, Mr. Dickherber supplemented his April 13, 1990, answer to the Staff's Order Suspending License, Show Cause Order, and Order Modifying License which were published in the 900711O112 900620 PDR ADDCK 05000254,

i Federal Reaister on March 5, 1990.1 On June 4, 1990, Commonwealth Edison provided a response to the NRC Staff's request for Commonwealth's views on the statements made by Mr. Dickherber in his answer and regarding Mr. Dickherber's performance.

The NRC Staff has evaluated the information provided by Mr. Dickherber and Commonwealth Edison and has determined that providing Mr. Dickherber with the opportunity for an Enforcement Conference, as described in 10 C.F.R. Part 2, Appendix C, is necessary before l

proceeding further with this matter. Mr. Dickherber agrees to this j

suggestion.

In consideration of the observation of Independence l

Day and personal schedules, the parties have' agreed to attend an l

Enforcement Conference on July 12, 1990, in the Region III Office.

I counsel for the Staff has conferred with counsel for Mr. Dickherber and the parties continue to believe that this matter may be i

i resolved, in whole or in part, without resort to litigation.

To this end, the parties request an additional 20 days from the j

July 9, 1990, filing date granted by the Board in its May 9, 1990, Memorandum and Order within which to conduct an Enforcement Conference and conclude discussions regarding the resolution of l

this matter.

Counsel for the Staff has conferred with counsel for Commonwealth Edison and Commonwealth Edison does not oppose the

granting of this further extension.

MOTION Accordingly, for the-reasons set l' orth above, the parties I Mr. Dickherber's supplemental Answer provided amplifying information regarding his working hours at the Quad Cities Nuclear Power Station preceding the incident which was the occasion for issuance of the Staff's orders.
