Dear Senator Mitchell:
This responds to your letter of April 10, 1990, to Chaiman Kenneth Carr, concerning the employment status of Mrs. Sydney faulkingham with the U.S.
Nuclear Regulatory Comission (NRC).
As a matter of policy, we do not believe it is appropriate to have employees work for both the NRC and a state in areas where we both regulate.
- However, NRC senior management did not advise Mrs. faulkingham of this view until they became aware of the situation some months after she was given pemission by her immediate supervisor. Therefore, I have made a one-time exception to this policy to allow her to continue her dual employment. We have advised Mrs. Faulkingham that she may continue her employment with the NRC under the conditions outlined in the enclosed letter.

SUBJECT:
DUAL EMPLOYMENT WITH NRC AND STATE OF MAINE This memorandum is written in response to your memorandum of March '10,1990, to Thomas T. Martin, Regional Administrator, Region 1.
In your memorandum you stated that you would resign your position with the NRC on April 30, 1990, but that, in the interim, you hoped the agency would reconsider the conflict of interest determination and allow you to maintain dual employment.
I have asked Mr. Martin to continue your NRC employment until I could reply.
