Dear Ms. Gilbert:
This is in response to your letter dated May 4, 1990, which you characterize se an appeal of an improper withholding of a portion of the record identified at number one of Appendix C of NRC's partial response of April 9, 1990, to your Freedom of Information Act (FOIA) request assigned number FOIA-90-29.
The portion of the subject record was not withheld under any of the FOIA exemptions because the portion of the record that was deleted consisted of information that was determined by NRC staff as not being within the scope of your request FOIA-90-29, as noted on Appendix 0, since your request FOIA-90-29 seeks two categories of records related to licensing of Radiation Sterilizers Inc. (RSI) and the-December 6, 1989, meeting concerning removal of WE3F cesium sources from RSI's facility.
Inasmuch as the information that was deleted pertained to separate discussiens with two other companies regarding use of WESF sources, the staff determined that the deleted information was not within the scope of your request FOIA-90-29.
Inasmuch as you submitted a separate request, FOIA-90-200, for
'the subject record, which was provided to you with NRC's response dated May 10, 1990, no further action is heing taken on your letter dated May 4 regarding this matter.
