I am responding to your May 10,- 1990, letter to Thomas Combs, asking for consents on several points of discussion covered during your May 1,1990, meeting with the' Nuclear Regulatory Commission (NRC)t staff. Our coments, below, correspond to the numbered points in your letter.

1.

Exclusion area means the area surrounding a reactor in which the reactor licensee has the authority to determine all activities including the

' exclusion or removal of personnel and property from the area. With-respect to low-level waste (LLW) storage activities, the NRC maintains sole jurisdiction within the exclusion area for all activities in

= accordance with 10 CFR 150.15(a). Outside the exclusion area, storage activities wculd be subject to Agreement State jurisdiction. With respect to LLW disposal, the Agreenent State has regulatory jurisdiction for licensing disposal-both within and outside the exclusion area.

The type and extent of issues covered during a hearing on an application are determined by the Administrative Law Judge or Panel assigned to hear "the' case.

You should note under this point, that the judge or panel will normally limit the scope of issues to that within admitted contentions submitted by.the parties.

10 CFR Part 61 agplies only to LLW disposal. Thus, the coments on

>" masking effects only apply to disposal facilities covered by Part 61.

Eliminate the words "Part 100 or" from the second line. Also, it should m

'be understood that the " lengthy and drawn out" process applies to a decrease in the size of the exclusion area.

A 10 CFR Part 50 license would not be required, only an amendment to the existing Part 50 license would be needed.

In many cases, the guidance and positions are straightforward.
