to JamesPartlow(NRC)datedOctober 28, 1988 After receiving your letter, the NRC contacted TVA and was informed that all memoranda or other reference attributing your terr.ination of services to conduct or inadequate performance has been expsoged from its records.

The TVA Office of General Counsel is retaining a copy of all docunents related to your 00L case. Access is tightly controlled and chese documents are not available for questions about prior employment. This was part of the settlement agreement in U.S. Department of Labor (D01.) Case No. 87. ERA-28 between yourself and TVA where you were also supposed to '.eceive backpay plus interest and attorney's fees and expenses. TVA is r.ot required to inform the NRC when it complies with the terms of the settlement.

Inaddition,theletterfromStevenA. White (TVA)toJamesG.Partlow(NRC) dated October 28, 1988 has been expunged from TVA files and the record retrieval system because it contained comments about your work performance.

This letter was written in response to our letter from James G. Partlow (NRC) to Steven A. White (TVA) dated Septeniber 12, 1988 concerning actions taken that may have a chilling effect on other personnel. The October 28, 1988 response does not meet our definition of a quality assurance document and TVA is not required to furnish information about its retention to the NRC.

We appreciate you informing us of.your concerns and we feel that our actions have lacen responsive.
