Dear Mr. Matthews:

The'NRC has completed a review of the Radiological and Engineering Assessment (REA) for the vicinity property numbered GJ-97011-0T, located in Grand Junction, Colorado.

Based upon our review, we conclude that the criteria of 40 CFR 192.21(c) has been met for the application of supplemental standards.- We agree that no remedial action is reasonable under the circumstances, and the requirements of 40 CFR 192.22(a) are therefore satisfied.

We therefore concur with the application of supplemental standards as proposed in the REA for vicinity property GJ-97011-0T.

The NRC is concerned with the post-UNTRAP disposal of contaminated mill tailings which remain in place as a result of the application of supplemental standards. Much of this material lies around buried utility lines or under roadways. Though supplemental standards were appropriately applied, allowing the material to remain in place, it is virtually certain that some of this.

contaminated material will be disturbed.

Utility line repairs and street repavements will generate contaminated material which will have to be disposed of for years to come.

We understand that the State of Colorado and DOE are working to determine an acceptable solution.

This is an important issue with potential impacts on the public health and, as such, the NRC is interested in a-resolution of this issue.
