Dear Mr. Handwerger:
With regard to the concerns expressed in your letter about indemnity exposure resulting from activities to be undertaken at the SUNY Buffalo reactor, the Nuclear Regulatory Commission, under the provisions of Section 170 of the Atomic Energy Act of 1954 as amended, indemnifies the licensee and any other

person who maybe liable for public liability arising out of a nuclear incident J
at the incemnified location. This indemnification of $500 million in excess of $250,000, would extend to the State University Construction Fund, your engineering consultant and contractor and all their employees and contractors.
