Is there any additional legal authority the Comission requires in order to resolve the licensing difficulties presented by state and local governments' refusals to participate in emergency planning?
CHAIRMAN CARR:
We do not believe that the Comission requires additional legal authority in the emergency planning area at this time. We believe that the Commission's 1987 " realism and utility plan rule," affirmed by the U.S. Court of Appeals for the First Circuit in 1988, offer a framework for avoiding the consequences of a state or local government's *efusal to develop an off-site emergency plan.
