Dear Mr. Edgar:
This is in response to your request for an exception to a requirement of 10 CFR 74.15 concerning DOE /NRC Fom 741. The exception would allow you to transfer a measured batch of decontaminated sand in several dump-truck loads j.
and to report the transfer of the batch as a single line item on Form 741.
l We have determined that granting your request will not adversely affect the l
common defense and security, nor the public health and safety, and is otherwise l
in the public interest. Accordingly, we are issuing a temporary license condition to Amendment SG-2 to your License No. SNM-1227 to read as follows:
I TC(MC&A)-2 Notwithstanding the requirement of 10 CFR 74.15 concerning DOE /NRC Form 741, ANF may transfer a measured batch of decontaminated lagoon sand in several dump-truck loads and account for the batch on a single 741 form at the completion of the transfer of the batch, as detailed in Attachments 1 and 2 to the letter from James B. Edgar to Donald J. Kasun dated May 9, 1990 (reference JBE: 90-053).
We agree that your letter dated May 9,1990 contains information of a type described in 10 CFR 2.790(d)(1). Such information is deemed to be commercial or financial within the meaning of 10 CFR 9.17(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.23.
