Please describe the Commission's position on " Dual Regulation".

~ CHAIRMAN CARR:
- As a general matter, the Commission believes that it is wasteful cf governmental resources and wuosserily burdensome on the regulated community when more than one regulatory authority is regulating the same environmentel problem, such as radionuclide emissions to the air.
Even where the law gives more than one governmental entity the right to regulate, it'is only sensible to minimize unnecessary duplication. For example, both the NRC and the Environmental Pro-tection Agency have regulatory authority over emissions of radionuclides from NRC licensed facilities. Section122(c)oftheCleanAirActdirectsEPA,to the maximum extent practic6ble, to take cognizance of NRC requirements and minimize duplication of effort and conserve administrative resources in the establishment, implementation and enforcement of emission limitations, standards of performance, and other requirements. As a general matter, if one agency's regulatory program is doing the job of protecting the public satisfactorily, other governmental entities should, where legally empowered to do so, defer to it.-
