Mh. BEVILL:

Describe the proposed mechanism of financing the NRC ccanerical waste program by use of the' Nuclear Waste Fund. What alternative financing mechanisms were proposed?

CHAIRMAN CARR:

Under NRC's proposed appropriations legislation, the_ Nuclear Waste Fund, con-sistent with the provisions of the Nuclear Waste Policy Act, would finance the NRC commercial nuclear waste program activities related to the disposal of i

high-level radioactive waste and spent fuel in a geologic repository.

This would be accomplished by the Congress appropriating monies directly from the Nuclear Waste Fund to the NRC as part of its appropri6 tion to the NRC. This is j

the same process that was used for fiscal year 1990.

There were two alternatives. The first is funding the NRC' nuclear waste i

program by appropriating funds from the Nuclear Waste Fund into a separate NRC appropriation account. This approach was not proposed because the current proposal accomplishes all of the objectives without the administrative buroen

of another appropriation. The second would re-establish a Memorandum of Understanding between NRC and DOE. This would require NRC to receive full appropriations from the general fund and then deposit monies received from the

-DOE as fees for NRC activities defined under the Nuclear Waste Policy Act into the Treasury.

Both the NRC and the Office of Management and Budget believe that a direct appropriation to the NRC from the Nuclear Waste Fund for our high-level nuclear

. waste activities, rather thar handling thic matter through the DOE appropria-tions process, more clearly identifies the funding with the agency expending the resources.
