In reliance on this-decision by the Licensing-Board, SAPL has~
L filed its May 16, 1990 Notice of Appeal.

Insofar as the Staff and Applicants' seek' dismissal of'SAPL's appeal, they should do so by themselves filing a-notice of appeal from that portion'of LBP 90-12 which states that the order j
dismissing SAPL from the proceeding was appealable.
They cannot eliminate the appeal on their motion to dismiss-it when the-Licensing Board ruled the decision was appealable.
