Dear Mr. Binns:

The White House has forwarded your letter concerning the proposed low-level radioactive waste disposal site in Riga Township, Michigan, to the Nuclear Regulatory Comission (NRC). NRC is responsible for licensing law. level waste disposal.

As you know, Michigan was selected by the Mid-West Compact to be the host state for a low-level radioactive waste disposal facility under the provisions of the Low-Level Radioactive Waste Policy Amendments Act of 1985. The Midwest Compact includes Indiana, Iowa, Michigan, Minnesota, Missouri, Ohio, and Wisconsin.

The State of Michigan (Mr. James F. Cleary, Commissioner, Low-Level Radioactive Waste Authority, Department of Management and Budget, State of Michigan,108 West Allegan, f554, Lansing, Michigan 48909) can provide additional information about the siting process.

If NRC receives a disposal facility license application from the Michigan Low-Level Radioactive Waste Authority, it will be reviewed against the regulatory requirements of Title 10 CFR Part 61 (enclosed). Also, since licensing a low-level radioactive waste disposal facility is considered a major Federal action, the National Environmental Prctection Act (NEPA) of 1969, as anended, is applicable. Only after review of all the information will NRC staff issue an Environmental Impact Statement, which includes discussion of alternatives, including sites.

Subsequently, NRC staff will decide on the issuance of a license.

Enclosed is a booklet providing a guide to 10 CFR Part 61 entitled, " Regulating the Disposal of Low-Level Radioactive Waste."

NRC staff must make a licensing decision on any low-level waste disposal facility application. Site characteristics such as land use, population characteristics and aspects of operations including waste container designs and the possibility of accidents are evaluated by NRC staff when the applicable documentation has been submitted as part of the license application.

I trust that this letter and the enclosures will lead you to a better eWh understanding of the basis for safe disposal of low-level radioactive waste.
