ORDER As a consequence of the NRC staff's May 25, 1990

" Motion'to Dismiss Notices'of Appeal ~from LBP-90-12,'" it has

come'to our attention thatJintervenor Seacoast Anti-Pollution League (SAPL) has filed an additional notice of.

appeal, dated May 16, 1990, from LBP-90-12, 31.NRC-(May 3,.1990).

In this new notice, SAPL appeals from "that portion of LBP-90-12 that purports to ' grantSAPL's motion to withdraw."

Notice of Appeal on Behalf of SAPL (May 16, 1990) at 1.

Because we were not aware until May 25 that this additional notice.had been filed, it was not reflected in Jour May 18, 1990 order setting a schedule for a staff dismissal motion, and intervenor responses thereto, relative to.the earlier May 11, 1990 notice of appeal from LBP-90-12 that had been filed by intervenor Massachusetts Attorney 7
