Withdrawal of Exemption Requests l

Dear Sirs:

GPU Nuclear letter 4410-89-L-0008, dated February 10, 1989, provided an evaluation of the applicability of'10 CFR 50 technical regulatory requirements.

to TMI-2 in Facility Modes 2 and 3.

The NRC letter dated April 26,_1990,-

regarding TMI-2 mode changes, referred to the GPU Nuclear 10 CFR 50 review and l

provided tacit concurrence with its contents and conclusions' Based on TMI-2's entry into Facility Mode 3 and the 10 CFR 50 review referenced above, GPU Nuclear has determined that the need for the following' three pending 10 j

CFR 50 exemptions has been obviated:

o GPU Nuclear letter LL2-81-0084, dated March 24, 1981, requested an

.l exemption from the requirements of 10 CFR 50 Appendix R Section III Part J involving the upgrading of emergency lighting.

Fire protection in Mode 3 is provided commensurate with the hazard.

Due-to the non-operating and defueled condition of TMI-2,.the requirements of Appendix R do not apply.

Therefore, this exemption request is no longer germane.

GPU Nuclear letter 4410-86-L-0075, dated May 15, 1986, requested relief from the requirements of 10 CFR 50.55a regarding Inservice Inspection Program Requirements for Category B and C valves.

In Mode 3, there are no protective functions performed by these '

i valves.

Thus, it is not.necessary to perform any inspections.or tests to ensure operability of these components.

Therefore, this exemption request is no longer germane.

GPU Nuclear letter 4410-88-L-0134, dated September 27, 1988, requested an exemption from.the seismic design requirements of General Design Criteria 2 for the TMI-2 Reactor Building (RB) floors 1

and D-rings and all systems within the TMI-2 RB, excluding the Reactor Yessel. The protection from natural phenomena, such as an earthquake, is principally. to maintain the isolation of the residual radioactive material which remains at the facility. During Mode 3 this function is perfomed exclusively by the Reactor Building and its various penetrations.

The interior structures and systems do not contribute to that function.

Therefore, this exemption request is no longer gemane.

GPU Nuclear hereby submits that the above exemption requests are no longer necessary and may be withdrawn from NRC consideration.
