SECY-90-073 - PROPOSED AMENDMENT TO THE AGREEMENT BETWEEN THE STATE OF UTAH AND THE U.S. NUCLEAR REGULATORY ColWISSION PURSUANT TO SECTION 274 0F THE ATOMIC ENERGY ACT OF 1954, AS AMENDED APPROVED $1nt DISAPPROVED AaSTAIN NOT PARTICIPATING REQUEST DISCUSSION With the recent clarification provided by the staff, rescinding the statement that "
. we do not believe that Federal or State ownership of the land is necessary for public health and safety or is a matter of compatibility under section 274" (see Memorandum from !!arold R. Denton'to Samuel J.
Chilk, April 11, 1990), I have no objection to the course of action recommendcd by the staff in the subject SECY paper.
My approval is contingent, however, upon my understanding that the Envirocare site will be limited to the disposal of NARM and low specific activity source material with average activity concentrations below 2 nanocuries per gram, and will not be used as a full scope low level waste disposal site.
Finally, I concur in the recommendation of Commissioner Remick that if the staff believes that use of the generic exeuption provision in section 61.6 poses a concern, staff should recommend for the Commission's consideration an approach for addressing this matter.
