Dear Senator Kerrey:

I am responding to your letter of March 21, 1990, regarding the relationship between Federal and State programs to regulate radioactive air emissions from low-level radioactive waste disposal sites. You expressed a concern that the Commission might administratively attempt to circumscribe the authority of States to regulate these emissions under the Clean. Air Act in a manner contrary to the intent of Congress. Additionally, you indicated that because of your past dealings with the Department of Energy (DOE), you find yourself unable to trust the Nuclear Regulatory Commission (NRC). As we understand the recent Senate action on the so-called "Simpson Amendment" to the Clean Air Act reauthorization bill on April 3,1990, the amendment would eliminate unnecessary dual regulation by EPA of radionuclide emissions currently regulated by HRC and at the same time preserve the right of States to set more stringent standards than those established by NRC for such. emissions. Insofar as the rights of states are concerned, this amendment would continue existing law. We have abided by this law since 1977, when states were first given this authority. We would obviously continue to abide by the will of Congress in the future. With regard to the issue of trust. I am particularly troubled _ that you have concluded that you cannot, trust-the N.RC1and'am~atTa loss to ~ understand what actions on our part have led you to reach ~ ~ ~ this conclusion.- Aside from the reference in your letter to your experience.with the Department of Energy over the shipment of radioactive waste -- a matter tnat in no way involved the NRC -- I simply do not understand the basis for your conclusion. If you are-aware of any. specific actions that have eroded your trust in-the NRC, please inform me as promptly as possible so I can follow up on your concern.
